Terms and Conditions
The following terms and conditions govern the relationship between the "Translator" (John Bunch) and the "Client" (the party purchasing translation services directly from the Translator). Ordering translation work, and accepting translation work from the Translator implies acceptance of the following Terms and Conditions:
1. Definitions: John Bunch, Translator, is a freelance translator and an independent contractor, and all the work performed by the Translator for the Client is solely on that basis. The Translator reserves the right to request part payment or payment in advance.
2. Corrections Period: No claims will be considered after 15 business days of the date of invoice. There is a time period of 15 business days after the Translator delivers the translation to the Client, which is the editing/corrections time period, in which the Client may request changes be made to the translation, at no additional cost to the Client. After that time period, the translation is then considered accepted as such by the Client, without the need for further corrections. Any such request for changes, edits, or corrections to the translation must be specific as to what is to be changed and must be in writing, and must be received by the Translator within 15 business days of the initial translation delivery.
3. Claims: Within the limits of the law, all claims will be limited to the amount of the invoice.
4. Client's Terms: The Client's terms of service are not in effect unless approved in writing by the Translator.
5. Relationship to the End Customer: If the Client is acting on behalf of an end client or third party, the translator's business agreement is with the Client only. The Client must pay the translator promptly, regardless of the end clients' or third party's payment policies, or agreements between the Client and end client.
6. Writing: All service orders for translation work must be placed or confirmed in writing, including a description of the project, the due date, rate of payment per source or target word, and payment deadline. There are no verbal agreements.
7. Copyright: The Translator retains copyright to the translation in full, until the invoice for the translation has been paid in full, at which time, the copyright transfers ("is assigned") to the Client and/or End Customer in full and is from that time on the sole property of the Client and/or End Customer. Any use of the translation without payment in full represents a copyright infringement under national and international law.
8. Public Use: If the Translator's work is available to the public after it is completed, for example in the form of a public website, company brochure, etc., the Translator may use the work and/or mention it in a portfolio or professional reference.
9. Cancellation: If the translation project is canceled after a formal work assignment has been made, the Translator will be paid for all work completed up to the time of the cancellation by the Client.
10. Changes to Terms of Payment: If the Client is not satisfied with the Translator's work, the Translator must be given the opportunity to correct the translation, before payment terms or rates are changed.
